By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.
The Site and its original content, features and functionality are owned by HookSounds and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Our Site may contain links to third-party sites that are not owned or controlled by HookSounds.
HookSounds has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of United States, without giving effect to any principles of conflicts of law.
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
The intellectual property rights relating to the site belongs to HookSounds. Any use, reproduction, distribution, marketing, or modification of any part of the site without the permission of HookSounds is prohibited and may lead to actions and lawsuits.
We believe in the quality of our products, support and services, but we understand that mistake happens. If you have an issue with your purchase, we will be happy to consider offering a refund. By purchasing music license(s) from our site, you agree to this refund policy.
A refund may not given in situations like the following:
When entering into one of the subscriptions available through the site, you accept that the music you gain access to, can only be used if you publish the content while your subscription is active. Then the license continues for the life of the publication (even if your subscription ends). You can not download the tracks, cancel the subscription and continue making content with our music. You can also white-list a number of channels during the time of your subscription which will be removed after your period of subscription ends.
If none of the subscription plans or individual licenses cover your business needs, feel free to contact us to create a custom flexible plan by writing to: support(at)hooksounds(dot)com or using the contact form.
In some of the plans, API or FTP access is included, allowing users to avoid having to manually log in and download the assets individually.
You will not use any robot, spider, other automated device, or software process to monitor, post to, or copy any content from the Website or the Website’s servers, except through APIs explicitly made available by HookSounds. You may not attempts to upload material, the access is granted to facilitate the assets download. You may use automated means to connect to HookSounds’s published API, to its FTP service, or to its SFTP service. Without limiting anything in this Terms of Service, HookSounds may terminate your account if, in its sole opinion, your usage consumes excessive system resources. Any attempted violation of these is logged in the server log for audit purposes.
Access is non-transferable. Lost or stolen credentials should be deactivated and reported to HookSounds immediately.
At the termination of the subscription service, all asset data and downloaded songs shall immediately either be ceased from usage, returned to HookSounds or destroyed as indicated by HookSounds at the time of termination.
We aim to uphold a website/environment free from content that could potentially contravene any pertinent laws or regulations, or encroach upon the rights of others. Should you find any content on our platform that you believe infringes upon your rights, violates any laws, or is otherwise unsuitable, please inform us immediately. We take such concerns seriously and will do our utmost to promptly address and resolve any issues. Please note that HookSounds does not take responsibility for any such content.
Lifetime subscriptions are a one-time payment offered periodically that provide licenses for our music, granting lifetime access to the HookSounds library and tools, as long as they remain available.
Some restrictions may apply to Lifetime Users.
New features introduced to these tools after the purchase of the lifetime subscription may not necessarily be included.
On Lifetime Plans: Due to the unique nature of Lifetime plans and the evolving nature of our service, we establish certain exceptions to its availability over the long term to align with the current state of affairs:
HookSounds reserves the right to modify the terms of lifetime subscriptions to enhance the plan with the introduction of new features or products, aiming to provide our lifetime users access to these innovations
Termination by HookSounds: HookSounds reserves the right to terminate an account without explanation if we detect the abuse of our services or other force majeure factors, without the obligation to provide detailed justifications. This includes instances where user actions may compromise the integrity of our services or violate the terms and conditions outlined herein.
The music shall only be used for the purposes set hereinabove and otherwise in accordance with the terms of this Agreement and the Plan to which the client is subscribed; no usage by shall be, or shall encourage or be associated with, illegal activities, and shall not infringe upon any third party rights in connection with the songs uses.
You may be asked to provide a credit, charge or debit card number from a card issuer that we accept in order to activate your Subscription – your authorizations in this section also apply to our payment processor and any other company who acts as a billing agent for us. You hereby authorize us to charge your specified payment method on a monthly or annual basis, in advance, for recurring Subscriptions, and to charge in advance for any course based or other subscription models, and/or to place a hold on your payment method with respect to any unpaid charges for Subscriptions. You authorize the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt. You authorize us to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You agree to provide updated payment information upon request and any time the information you previously provided is no longer valid. You acknowledge and agree that neither HookSounds, nor any HookSounds agent, will have any liability whatsoever for any insufficient funds or other charges incurred by you as a result of attempts to charge, and/or place holds on, your specified payment method as contemplated by these Terms.
If you have received a discount code or free offer/trial period from HookSounds or from a third party acting on behalf of HookSounds for access to a paid Service, that access may be subject to separate additional terms and conditions for that offer. You must agree to these terms in order to use our services.
If you have been offered a free trial, HookSounds reserves the right, in its sole discretion, to determine your eligibility for a trial. If it is determined that you are ineligible to use the features of the free trial, HookSounds may change or terminate the trial for your account at any time with prior written notice. Some trials require you to provide payment details to start the trial. At the end of such trial period, if you have not decided to terminate the contract, HookSounds will automatically bill for the provided services according to the agreed terms provided.
Your subscription can be canceled at any time using the corresponding button in your user profile. To ensure proper cancellation and to avoid an unwanted renewal fee, we strongly recommend canceling the subscription a few days before the end of the currently active subscription or trial period. After your plan is successfully canceled, it will remain active until the end of the current billing cycle. In the case of a free trial period, access to the subscription features ends at the time of termination. We do not offer refunds for any fees or charges associated with your subscription plans – this includes partial or unused periods for which you have already paid. Your obligation to pay Fees will continue until the end of your Single Term. Any subscription fees or charges associated with your subscription plan are non-refundable. All open invoice amounts are due and payable immediately after termination.
